Stock Prices and Availability

Unless otherwise stated, all prices include New Zealand Goods and Services Tax (GST) of 15%. Prices, specifications and availability are subject to change without notice.
If an item is not yet available when you order, we will let you know the supplier’s expected release date. You may withdraw your order if you do not wish to wait. Certain goods may be at the end of a line or have limited time available for purchase. Image Audio Ltd cannot guarantee products will always be available when you place your order. All specials and promotions are limited to stock on hand or items ordered within a specified time frame.

Payment and Title

Payment for online orders shall be made by credit card only (Visa & MasterCard). Payment for telephone orders may be made by credit card, direct credit or cleared cheque prior to dispatch of goods.

Should payment for supply of goods or services be outside of, or beyond, our payment terms you will be liable for all costs, fees, damages, and expenses including legal costs (on a full indemnity basis) and all other fees incurred by us in recovering the amount outstanding. Ownership of the goods remains with Image Audio Ltd and does not pass to you until we receive all amounts you owe to us.

If we cancel your order

We reserve the right to cancel your order for the following reasons:

• We do not deliver to your location. Note we only deliver goods within New Zealand.
• One or more of the goods you ordered was listed at an incorrect price due to typographical error or an error in the pricing information received by us from our suppliers.
• We have reason to suspect that credit card details are incorrect or you are not the authorised cardholder.
• Your contact details and or shipping address is incomplete

Delivery Policy

Free delivery to main centres within New Zealand unless otherwise stated.
Contact us for rural delivery charges.

We endeavour to ship items within 3-5 Business days.
Standard shipping for orders placed on is by Post Haste Couriers
Delivery times may vary depending on whether the item is in stock, the weight and size of the item, and are subject to carrier delay outside of our control.

Taking Delivery of your order
All order deliveries require a signature. We will attempt to deliver your item 3 times in order to obtain a signature before returning the item back to our warehouse. Items will not be left unsecured at private or commercial premises under any circumstances.

If the delivery courier is unable to obtain a signature, a calling card will be left with details as to how you may arrange a pick up or re-delivery of your order.
We do not deliver to Post Office Boxes or Private Boxes

Force Majeure
Should Image Audio Ltd be delayed in or prevented from making delivery owing to any cause whatsoever beyond Image Audio Ltd’s control, then Image Audio Ltd shall be at liberty to cancel or suspend the order without incurring liability for any loss or damage resulting therefrom.

Safety Operating Instructions
The owner’s/operator’s safety is Image Audio Ltd’s primary concern. The customer shall be required to agree, prior to purchase, to read and follow the safe operating instructions of equipment purchased from Image Audio Ltd, and where relevant, equipment that it is to be used in conjunction with.

The manufacturer’s warranty starts from the date of sale. The terms of warranty cover defective workmanship or materials. In the event there is a need to make a claim, the goods shall be returned to Image Audio Ltd, in original condition, for inspection. The customer shall be responsible for the cost of returning the product. Should the problem be a legitimate claim, the product will be repaired and returned freight free. Image Audio Ltd will have sole discretion to repair or replace the goods.


Returns Policy

Please choose carefully as we do not have to provide a refund if you have changed your mind about a particular purchase.

Under the Consumer Guarantees Act 1993 (‘CGA’), you have guaranteed legal rights for goods [and services] you buy. These are called ‘consumer guarantees’, and include the following: (1) a guarantee that the goods are of acceptable quality, such that the goods are: fit for all the purposes for which goods of that type are commonly supplied; free from minor defects; safe, durable; and acceptable in appearance and finish; (2) a guarantee that the goods are fit for any particular purpose made known by you, or for which we represent that they are or will be fit; (3) a guarantee that the goods correspond with any description with which the goods are supplied; and (4) a guarantee that the goods correspond with any sample or demonstration model where the goods are supplied by reference to such sample or model. If the goods [or services] we supply do not meet a consumer guarantee, we will meet our obligations under the CGA to provide a remedy. These guarantees are in addition to any warranty offered by a manufacturer. The CGA does not apply where the goods have been used in a manner, or to an extent which is inconsistent with the manner or extent of use that a reasonable consumer would expect to obtain from the goods; and the goods would have complied with the guarantee of acceptable quality if they had not been used in the manner or to that extent.


Minor Failure

If the goods [or services] we supply do not comply with a consumer guarantee, but can be remedied within a reasonable time, we will either repair the goods or replace the goods with goods of identical type. If we cannot repair or replace the goods within a reasonable time, we will provide you with a refund of the purchase price.


Major Failure

A ‘major failure’ is where the failure in the goods cannot be repaired or cannot be repaired within a reasonable time, or where the failure constitutes a ‘failure of substantial character’ as set out by section 21 of the CGA. If a failure amounts to a major failure, you are entitled to return the goods and choose to have a replacement of the returned goods or a refund. Alternatively, you may elect to retain the goods and obtain compensation for the reduction in value of the goods. Where you choose a replacement, we will where available, provide goods of the same type and similar value to the returned goods, like- for – like.

Delivery Charges
Any shipping costs to return the original goods to Image Audio Ltd will be at the cost of Image Audio Ltd, where Image Audio Ltd considers the goods to have breached a consumer guarantee. If on examination of goods returned to Image Audio Ltd, the goods are found to not be in breach of any consumer guarantee. Image Audio Ltd may charge you a fee for examining the goods, and any cost to return the goods to you. Please note that goods must be returned within a reasonable period and you will be asked to demonstrate that you have purchased the goods from Image Audio Ltd and that the problem with the goods was not your fault.

Refunds will be issued at the discretion of Image Audio Ltd. Refunds will normally be processed within seven (7) Business days.

Goods damaged in transit
If any goods arrive damaged, please contact the Image Audio Ltd within 24 hours of delivery. We will arrange to have the damaged item returned and either repair or replace the goods or refund the price to you, at its election. Damaged goods must be returned in the condition received by you with all original packaging, together with all packing slips.

This returns policy is not intended to exclude or limit any rights which you may have as a consumer under the Consumer Guarantees Act 1993, and may not necessarily describe all rights you may have.

Image Audio Ltd respects your privacy. We do not use cookies or any other mechanism to capture or maintain information from users without their consent. The only personal information we capture has been specifically submitted to us through forms clearly identified for that purpose.
Where we do ask you to provide personal information (such as name, e-mail address, and telephone number), this information will be used solely for the purpose stated, or to contact you with relevant information. If you wish to remove or change your information held by us, we will promptly take action to comply with your request.

This website and Trademarks, Patents and associated content and material owned by Image Audio Ltd is protected by copyright. Unauthorised use of any content is strictly prohibited and may infringe on intellectual property rights held by Image Audio Ltd. Copyright of some material may be held by the suppliers of Image Audio Ltd, in which case the suppliers retain all rights.

Consumer Guarantees Act
If you are purchasing or holding yourself out as purchasing the Products for a business purpose, then the provisions of the Consumer Guarantees Act 1993 (New Zealand) are excluded from any supply agreement and to the extent permitted by law, all statutory or implied conditions, warranties and guarantees which would apply are expressly excluded.

If we fail to enforce any terms or to exercise our rights under these terms and conditions at any time, we have not waived those rights.

If in the event that any part of these terms and conditions will be determined to be invalid, unlawful, or unenforceable for any reason, such terms and conditions will be severed from the remaining terms and conditions which will be valid and enforceable to the fullest extent permitted by law.

Governing Law
The use of this website and these Terms and Conditions shall be governed by the Laws of New Zealand. Any legal action arising out of its use shall be brought and enforced under the Laws of New Zealand shall be within the exclusive jurisdiction of New Zealand.

Changes to Terms and Conditions
We reserve the right to alter these Terms and Conditions at any time and without notice.
